THIRD REQUEST FOR
PUBLIC INFORMATION DOCUMENTS
PLEASE READ THROUGH TO THE BOTTOM FOR THIS MORNING’S
COMMENTS TO THE NAV DISTRICT
I have turned in 2 Public
Information Act (PIA) requests to this body seeking the same information and your
attorney continues to play word games; the only reasonable explanation of which
is because he and this body doesn’t want the truth to get out of what lies with
what I am asking. Twice you have
interpreted my request as a meeting of the navigation and canal commission and
provided me with a word for word exact same response the second time. You could interpret it as a meeting of the
Joint Chiefs of Staff but that doesn’t make it so. I was specific with the second request but
apparently you desire a different level of specificity.
I am requesting the PIA information in the name listed 3
times on your website face page, the Aransas County Navigation District.
I am requesting the PIA information in the name listed 47
times in the 2021 Financial Audit prepared by BRENDA P MCELWEE, the Aransas
County Navigation District.
I am requesting the PIA information in the name Aransas
County Navigation District, (the District) used an additional 69 times in the
2021 Financial Audit.
I am requesting the PIA information in the name in which you
receive Ad Valorem taxes, Aransas County Navigation District
I am requesting the PIA information in the name of the
entity listed on the property tax information of the Aransas County Appraisal
District, the Navigation District.
I am requesting the PIA information in the name contained in
28,950 tax bills just mailed by the Aransas County Tax Assessor to Aransas
County residents, the Navigation District.
I am requesting the PIA information in the name of that
entity that I asked for Financial matters in a Freedom of Information Act
request in March of this year and that you provided me with 119 pages of
information. the Aransas County Navigation District, ACND, and the District. The cover of the binder provided me shows the
respondent’s name to be the Aransas County Navigation District.
Now I ask, is there any doubt about the name of the entity
that needs to cough up the records requested in this Public Information Act
request that follows?
Mr. Benadum, your continued playing games with my lawful
request only strengthens my resolve and proves you are trying to hide the truth
not only from me but from every resident of Aransas County.
This request is made under the Public Information Act, Texas
Government Code chapter 552.
Provide the Agenda of the meeting of the Aransas County
Navigation District where Commissioner Tommy Moore was approved, appointed,
instructed or otherwise allowed to affix his signature to the Notice of
Deadline to File an Application for Place on the Ballot. Provide also the Minutes of that meeting, the
exact wording of the motion made to accomplish the aforementioned, the
Commissioner who made the motion, the Commissioner who seconded the motion and the
record vote.
Provide the Agenda of the meeting of the Aransas County
Navigation District where Harbor Master Keith Barrett was approved, appointed,
instructed or otherwise allowed to affix his signature to the Amended
Notice: Notice of Deadline to File and
Application for Place on the Ballot.
Provide also the Minutes of that meeting, the exact wording of the
motion to accomplish the aforementioned, the Commissioner who made the motion,
the Commissioner who seconded the motion and the record vote.
Last Navigation District meeting, I was limited to 3 minutes
and was cut off when I reached that time limit.
This morning under the Citizens to be Heard section of the District’s
Agenda, I read the above comments. Before
doing so, I handed Chairman Dieckow a copy of the District’s Rules of Procedure,
Conduct and Decorum, pointing out that Article IV, Public Participation in
Meetings, Citizens have 5 minutes to deliver their comments. The Chairman bluntly informed me I had 3
minutes – no explanation. I should not
have been surprised; the District has a history of disregarding rules even when
they are their own.
